We, Ashok kaul and others are originally residents of 79/80 Banamohalla (Habakadal) Srinagar, Kashmir are at present migrants.
The below listed are owners of their ancestral orchard land, total measuring 96 Kanals and 19 marlas having together bearing (900) almonds trees, (1100) Apple trees (40) Walnut trees, (950) Apricot Trees and (500) Kikar Trees. The land is located in village Sheikhpora Tehsil and Distt. Budgam, Kashmir. The bears Khasra nos 178/265/274/275
Due to outbreak of the militancy the co-owners with there families were forced ro Migrate and leave their homes and hearths at their native place to various parts of India where they are residing at present.
However Gulam Qadir Dar S/o Gh. Nabi Dar R/o Rambagh, Srinagar (J&K) Mohammad Sultan Dar S/o Gh. Nabi Dar R/o Rambagh, Srinagar (J&K) on strength of muscle power and money powers and above all in connivance with some unscrupulous revenue agencies and other administrative officials who provided tacit illogical assistance from time to time and changed the title of land in favour of respondent Gulam Qadir Dar and Mohammad Sultan Dar by virtue of Mutation Order No 444 dated 2nd May 1989(i.e even before actual migration) then attested by one erring Tehsildar (settlement) Chaudura (Budgam) namely Mohd. Amin Indrabi even at that time there exist no enforceable documents. Thereafter Gulam Qadir Dar S/o Gh. Nabi Dar R/o Rambagh, Srinagar (J&K) Mohammad Sultan Dar S/o Gh. Nabi Dar R/o Rambagh, Srinagar (J&K) gave Oral Gift Gh. Rasool Dar S/o Abdul Ahad Dar R/o Humhama Tehsil and Mohamad Sultan S/o Gh. Qadir Dar R/o Humhama Tehsil vide mutation no 632 dated 26th June 1996..
The above transaction is illegal because.
Report submitted by the Naib Tehsildar to Tehsildar Budgam further to Additional Commissioner Kashmir N0 256-57/08 Dt 28-5-2005 .
In compliance to your letter no 270/AP dated 13/5/2005 under said visited the spot on 16-5-2005 along with Naib Tehsildar and Field Agency.
"The mutation no 444 was attested by Mohd Amin Indrabi Ex-Tahsildar, Chadura in favour of Mohd. Sultan Dar on 02-5-1989 .
another mutation no 632 was done on 26-06-1996 land measuring 18 canals as oral gifts attested by Syed Mohd, Haddi ex NaibTehsildar in favour of Haji Gulam Rassol Dar S/o Gulam Kadir Dar (8 Canal & 10 marlas) as donnees on behalf of Mohd. Sultan and Gulam Kadir S.o Gulam Nabi dar. donors.
As per record the land in question was under the ownership of Pran Nath Kaul and others since long. The Part I- Sarkarcopy of mutation nos 444 and 632 of village Sheikhpora are not traceable at Tehsil record room and it is not possible to ascertain whether the owners Pran Nath Kaul and other were present at the moment of attestation of mutations or not. on spot the land in question was in shape of orchids and after attestation of mutation in quesiton the shape of the said land changed from time to time and earth cutting and cutting of planted trees is also taking place on spot.
The then Deputy commissioner and other subordinates stopped the cutting of earth, started by the owners

Please investigate the wrong doings and revert the land title back to rightful owners that is Sh. Pran Kaul and others .

- The alleged mutation has been done under Govt Directive Section 121 J&K land settlement Act 1987. The Act was revoked under order of 239/FC-AP dated 07/12/2001. Hence the said mutation is illegal. All over J&K state mutation under this Directive 121 have been revoked. However the said mutations have not been revoked.. Hence made an appeal with FC to revoke the mutation.
